The terms of using FlowSense.

1These terms

These terms govern your use of the FlowSense website and platform, operated by Sewtreat ("we", "us", "our"). By using the site or the service you agree to them. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind that organisation.

2The service

FlowSense provides monitoring, alerting and reporting for water treatment operations, drawing readings from your plant equipment.

FlowSense is a monitoring and reporting tool. It is not a control system, and it is not a substitute for your own operational procedures, statutory testing, or the judgement of a qualified operator. You remain responsible for the safe and compliant running of your plant.

3Accounts and access

Access is provided to named users under your organisation's subscription. You are responsible for keeping credentials confidential, for activity under your accounts, and for telling us promptly if you suspect unauthorised access.

We may suspend an account that is being used in breach of these terms or in a way that threatens the security or stability of the service.

4Acceptable use

You agree not to:

• Use the service unlawfully, or in breach of any regulation applying to your operation.
• Attempt to gain unauthorised access to any part of the platform or another customer's data.
• Reverse engineer, copy or resell the service without our written permission.
• Interfere with the operation of the platform or the networks it runs on.

5Your data

Plant and operational data you put into FlowSense remains yours. You grant us the limited right to process it in order to provide the service.

We will not sell it or disclose it to third parties except as set out in our Privacy Policy or where the law requires. On termination you may request an export of your data within 30 days.

6Availability

We aim to keep FlowSense available continuously, but we do not guarantee uninterrupted service. Planned maintenance will be notified in advance where practical. We are not liable for downtime caused by matters outside our reasonable control, including network failures, power outages, or faults in your own equipment or PLCs.

7Fees

Fees, billing frequency and the subscription term are as set out in the quotation or order form agreed with you. Amounts are in South African Rand and exclude VAT unless stated otherwise. Late payment may result in suspension of access after reasonable notice.

8Intellectual property

The FlowSense platform, its interface, branding and underlying software remain our property. Nothing in these terms transfers ownership of them to you. You may use the service for your own operations for the duration of your subscription.

9Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with the service is limited to the fees paid by you in the 12 months preceding the claim.

We are not liable for indirect or consequential loss, including loss of profit, production or reputation. Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act where it applies.

10Termination

Either party may terminate at the end of the subscription term on reasonable written notice. We may terminate immediately for material breach that is not remedied within 14 days of notice. On termination your access ends and, after the export window, your data may be deleted.

11Governing law

These terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.
